Women in India have equal legal rights for owning, buying, inheriting, and selling any kind of property. However, it may be noted that the extent of such property rights of women in India depends on the kind of property, personal laws, family conditions, and prevailing legislation in the country. Knowledge of property rights of women in India will assist women in making the right decisions regarding buying property and inheriting the same.

At Aashray Realtors, it is believed that knowledge of property laws is very important for any home buyer and property investor. The following are the major legal rights of women concerning property ownership.

1. What Are the Property Rights of Women in India?

Rights to property by women

It is important to understand the concept of the property rights of women, which are legal rights of owning, acquiring, inheriting, transferring, and managing property. In India, the law accepts the rights of women to possess property in their names based on the laws of India.

Any woman can buy a flat, house, plot of land, or business property either with her money or even taking a home loan. Women have the right to be gifted property, inherit it from her parents or her husband, and also through a will.

Women have the right to sell, rent, gift or transfer any property which belongs to them.

2. Property Rights of Daughters in Ancestral Property

One of the major changes that occurred in Indian property law pertains to the rights of daughters with regard to ancestral property in Hindu law.

According to the Hindu Succession (Amendment) Act, 2005, Section 6 of the Hindu Succession Act, 1956 was amended. The amendment provided that a daughter shall be considered as a coparcener in a Hindu Mitakshara joint Hindu family, along with a son having equal rights.

Main features are as follows:

The daughters are entitled to the coparcenary rights and liabilities of sons.

A daughter is able to claim her legal share in the qualifying ancestral/joint family property.

Marital status of a daughter does not deprive her of the coparcenary rights.

She is able to dispose of her coparcenary interest according to the relevant legislation.

In its landmark judgment Vineeta Sharma v. Rakesh Sharma (2020), the Supreme Court established that a daughter has the right from the moment of her birth independently of whether her father was alive on 9 September 2005.

Not all properties owned by the parents are ancestral properties. In particular, self-acquired property, inherited property, and joint family property can be distinguished in this respect.

3. Women’s Rights to Inherit Property from Parents

A woman can inherit property from her parents according to the prevailing succession laws.

According to the Hindu Succession Act of 1956, a daughter is considered a Class I heir of her father in case the deceased died intestate. This means that the deceased died without making any legal will.

In the same way, a Hindu woman can inherit property from her mother in accordance with the prevailing succession laws.

Some important factors include:

Whether the deceased left any valid will.

Whether the property is self-acquired or a joint property in the Hindu family.

Which law of succession prevails for the family.

Whether any other legal heir claims the property.

For women who belong to communities such as Muslims, Christians, Parsis, and others, inheritance laws might differ. It is thus important for women to check the personal law which prevails before inheriting any property.

4. Property Rights of a Wife in India

The property of a married woman can be owned independent of her husband. The marriage cannot be considered sufficient to become a joint owner for the properties of both.

In case the wife buys a property using her name, she becomes the owner of the property based on the title papers and other requirements of the law. In case both the husband and wife have been mentioned in the ownership papers, the ownership of each spouse will depend upon the ownership papers.

A widow, being a class I heir of the deceased husband under the Hindu Succession Act, can inherit the property of her deceased husband.

It is very essential to know that marriage itself is not sufficient enough to make the wife an owner of any particular share of the property of the husband.

5. Women’s Rights in Property After Divorce

However, it is not true that upon divorce, the woman automatically becomes the owner of half the property that belongs to the man with whom she was married.

Even when divorced, a woman who is the co-owner of the property is entitled to raise the issue of ownership as per the law.

Section 25 of the Hindu Marriage Act, 1955 allows courts to order for alimony or maintenance on a permanent basis under certain conditions. Section 27 of the same law provides for certain properties presented at the time of marriage belonging to both the spouses.

Other laws relating to maintenance and matrimonial issues can also be invoked under specific situations.

Women need to consult legal experts regarding their property rights.

6. Property Rights of Women Under the Domestic Violence Act

Protection of Women from Domestic Violence Act, 2005, grants some rights as far as residence of the woman is concerned.

Section 17 grants a woman who is aggrieved in a domestic relationship a right to live in the shared household according to the provisions of this Act. This provision in itself does not give the aggrieved woman any ownership rights of the property.

The court may also make residence orders under Section 19.

It becomes relevant when a woman is suffering from domestic violence or being illegally excluded from the shared household.

7. Benefits of Buying Property in a Woman’s Name

There may be several benefits of buying real estate in a woman’s name, but they may vary by state and by the terms of financing.

Possible benefits are as follows:

Stamp duty rebate: Stamp duty rebate is provided to some women in India, depending on the state where they reside and its specific laws. Conditions and rebates differ by state.

Home loan offers: Women get special housing loans in India offered by certain banks, depending on the current lending policy of each bank.

Personal independence: Buying real estate in her own name gives financial freedom and allows women to accumulate wealth for the future.

Renting out the property: A woman owner of real estate can rent out the property and get rental payments, which will depend on the current tax situation.

Investment in property: Residential and commercial real estate properties can become one of the investment instruments.

8. Important Documents for Protecting Women’s Property Rights

Maintaining the accuracy and security of the documents related to the property will ensure ownership and avoid disputes.

The documents that need to be checked by women acquiring or inheriting property are as follows, wherever applicable:

Registered sale deed/conveyance deed.

Documents concerning title of the property along with documents regarding past owners.

Mutation along with land or municipal records.

Encumbrance certificate or any document related to registered rights.

Will/probate/succession certificate/legal heir certificate, whichever is applicable.

Gift deed or partition deed, whichever is applicable.

Home loan/co-ownership documents, wherever applicable.

Mutation in land/municipal records usually serves the purpose of updating revenue or administrative records. However, by itself mutation cannot establish the legal ownership of the property.

9. How Women Can Protect Their Property Rights

Some of the measures that women can adopt to secure themselves legally and financially include the following:

Check the title: Investigate the title to ensure it is in order.

Know about the inheritance laws: Establish the succession laws and ascertain the legal share.

Safe keeping of documents: Maintain proper documents in the form of registered deeds, wills, and others.

Do not sign under coercion: Always read and understand the terms and conditions of relinquishment deeds or transfer deeds.

Consult a lawyer: Seek the guidance of a property lawyer in case of disputes over inheritance, unclear title, or other family issues.

Carry out all necessary registrations: Make sure that property transfers are properly recorded through necessary registrations.

Conclusion

The rights of women in India with regard to property have been established with great success; some important rights regarding ownership, inheritance, ancestral property, and residence have been guaranteed. However, it must be noted that the rights available to any particular woman vary according to the succession laws and other documents concerning ownership of the property.

Whether buying the first house or residential land, or inheriting a piece of land, one needs to know some property laws.

Aashray Realtors motivates home buyers to make wise property decisions by taking into account proper documentation and legal title verification.

Property Ownership is an Important Step towards Financial Independence and Security.
